Make sure that your facility sign complies with the specifications listed for your facility in the DMV Commissioner's Regulations.

What if I do not receive the application to renew the facility license for my inspection station?

How can I order inspection stickers and forms MV-50?

On-line (inspection stickers only)

Inspection stations can order inspection stickers on-line. You must provide your facility number, the type of stickers you that you need, and an e-mail address to receive your confirmation. Use a credit card to pay for the order. The order normally arrives in two weeks if you use standard postal delivery, or less than two weeks if you use an express mail service. There is a fee of $10 for express mail service.

In person (Albany only)

You can bring your order to the service counter of the Division of Vehicle Safety Services. The service counter is located in Room 110 on the First Floor in Core One of the Swan Street Building at the Empire State Plaza in Albany. How do I determine the amount of my credit?

After your credit is processed, you receive a letter that indicates the amount of your credit. You must provide your facility number to use this service.

What if I received the wrong stickers or I need to return stickers?

Write a letter to the DMV and explain why you returned the stickers.  Include the stickers, facility name, and facility number. You can exchange the stickers for the correct stickers or you can receive a credit. Make sure that you include these instructions in the letter. Put the stickers in a strong envelope. Postal machines can damage standard envelopes that contain a thick document and can lose the stickers.

What if my stickers or forms MV-50 are stolen?

File a report with the police. Send a copy of the report to the DMV, and keep a copy for your records. Report the theft even if you do not replace the stolen items. If you need to replace the items, make sure that you include a payment when you send the report to the DMV.  A DMV Inspector will deliver your next order of documents in person.

What if my stickers or forms MV-50 are lost?

Write a letter to the DMV and explain that your items were lost.  To replace the lost items, make sure that you include your order and your payment when you send the letter.

The business at my dealership has increased. How do I get additional form MV-50 books?

Hearings and Waiver Notices

How do I accept or reject a hearing waiver?

Carefully read the hearing waiver notice that you received. To accept the waiver, mark the correct box on the form. Mail the form to the address listed on the form. Make sure that you include a personal check and the required business documents described on the form.

How do I determine the date, time and location of my hearing?

The DMV notifies you by mail of the date, time, and location of your hearing. The hearings are held at different locations in NYS. The DMV tries to schedule the hearing at a location near your facility.

How do I get a hearing changed to a later date?

The DMV Hearing Bureau does not give adjournments unless all circumstances demonstrate good cause. Request your adjournment early, but no less than seven days before the date of the hearing. Include the reason why you requested the adjournment, your address and your daytime telephone number. You or your attorney can request the adjournment by mail.  Send the letter to:

Suspensions, Revocations, Civil Penalties, Appeals

Why was my facility license or my facility registration suspended or revoked?

Read the Notice After Hearing that you received from the DMV. The notice explains the reasons why your facility license, facility registration, or inspector certification was suspended or revoked after a DMV hearing.

When does the suspension or the revocation begin and how do I comply?

The suspension order or the revocation order indicates the date that a suspension or a revocation will begin. Read the following list of items. You must surrender the correct items to a regional office of the Division of Vehicle Safety Services or to the DMV Central Office in Albany. The DMV must receive the correct items no later than the date that your suspension or revocation will begin.

What if the facility does not surrender the items before the effective date?

If the facility does not surrender the required items before the effective date of the suspension or the revocation, the period of the suspension or the revocation is extended.  For example, a facility is suspended for 30 days. The facility does not surrender the certificate until 10 days after the effective date listed on the suspension order. The certificate is suspended during the 10 days andfor 30 days after the facility surrenders the items. 

How do I pay a civil penalty or restitution?

To pay a civil penalty, you must send a certified check or a money order payable to "Commissioner of Motor Vehicles." To pay restitution to the customer who filed the complaint, send to the DMV a certified check or money order that is payable to the name of the customer.

The DMV cannot terminate your suspension for failure to pay a civil penalty until your payment is processed in the Central Office in Albany.

What can I do if I receive a letter or a suspension order for a bad check?

Return the letter and two certified checks or two money orders. Write one check or one money order for the amount of the bad check. Write the other check or the other money order for the amount of the penalty fee of $35. Make the checks or the money orders payable to "Commissioner of Motor Vehicles." If you do not have the letter, you can call the Accounting Unit at (518) 474-5913 to determine the correct amount.

What can I do if I do not agree with the decision made by the hearing judge?

Use form AA-33A (Appeal from DMV Hearing Determination) to file an appeal with the DMV Appeals Board. Form AA-33A includes instructions. You must file the appeal no more than 60 days after the date of the decision letter or the notice.

What standard items of vehicle equipment are not required parts of a safety inspection?

The items in the following list are not a required part of a safety inspection for light-duty and medium-duty vehicles. While some of the items are illegal equipment, the inspection station is not required to inspect the items. You can inform the customer that the item is illegal or that the item does not function. These items cannot cause you to reject a vehicle. The items are:

What faults can cause the rejection of a serpentine belt on a vehicle that has power steering?

You can reject the serpentine belt if any pieces of the serpentine belt between the grooves are absent or any part of the serpentine belt is frayed.

Can a NYS inspection station inspect a vehicle that is registered in another state?

Yes. DMV Regulation 79.8(b)(1) requires an inspection station to inspect any vehicle it is qualified to inspect and includes vehicles registered in other states. Advise the customer that not all states recognize the NYS inspection.

Can I inspect a vehicle that is not registered or does not display vehicle plates?

Yes. Refer to form VS-28 or form VS-1074.

High-Enhanced Emissions Inspections for the New York City Metropolitan Area (NYCMA)

If I enter incorrectly into the NYTEST analyzer that an item has passed, but the item did not pass, how do I correct the error?

You can change your entry before you continue to the next section of the inspection.  The NYTEST analyzer requires you to confirm your entries before you continue to the next section of the inspection. Make sure that you check the entries on the NYTEST display screen and correct the entries before you confirm the results. You cannot correct the entries after you continue to the next section of the inspection.

If you did not correct the error through the process described above, and the vehicle passed the inspection:

If the vehicle failed the inspection, your NYTEST analyzer allows you to reinspect only the failed sections of the inspection during the next 30 days. The NYTEST analyzer does not allow you to change any sections of the inspection that were passed.

The NYTEST analyzer indicates that the facility license is expired, but the facility license was renewed. Why?

You must use the NYTEST barcode scanner to read the barcode on the facility license renewal document.

The NYTEST analyzer displays a lockout message on the display screen. How do I correct the lockout?

When you turn on the NYTEST analyzer, the machine conducts a series of internal checks before it displays the main menu. If the system fails any of the checks, the NYTEST analyzer displays a lockout message. Read Section IX of the VS-28 Emissions Inspection Procedure Manual to get a list of lockout messages and corrective actions. If you use the actions described in the manual, but cannot correct the lockout, contact your equipment vendor.

How do I use the data refresh command on the NYTEST analyzer?

You normally use the data refresh command to update the data in the NYTEST analyzer if:

The data refresh command is listed in the station manager menu on the NYTEST display screen. The location of the station manager menu depends on the brand of NYTEST analyzer you use. The station manager menu is displayed in the main menu or the utility menu.

I recently received a warning letter from the DMV about a failure to communicate inspection data. How do I correct the problem?

Carefully follow the instructions in the warning letter, and contact the vendor of your NYTEST analyzer if necessary. You are not required to contact the DMV if the problem is quickly resolved.

What can occur if I ignore a warning letter?

If you correct the communication problem quickly and send your inspection data to the DMV, the DMV will not take action.  If you do not correct the problem quickly, the DMV can reject your order for inspection stickers until you correct the problem.

A NYTEST stop message appeared on the NYTEST display screen and I cannot conduct an inspection. How do I remove the message to continue inspections?

There are several possible reasons for a NYTEST stop message to appear.  To determine the reason for the message, call the Technical Services Bureau at (518) 474-5282. The Technical Services Bureau can advise you how to correct the problem and how to remove the message.

How do I learn more about my responsibilities to the data manager?

Refer to the TESTCOM Enrollment Form and Agreement that you completed when you entered the High-Enhanced Emissions Inspection Program. Read the sample agreement in the appendices of the VS-28 Enhanced Emissions Inspection Procedure Manual, or call TESTCOM at 1-800-678-9199.

My NYTEST analyzer frequently needs repairs and is not repaired correctly. What can I do?

Read your service agreement. Notify the vendor of your NYTEST analyzer immediately and explain the problems. If you determine that the service you receive from the vendor does not comply with the agreement, call the NYS Department of Environmental Conservation at 1-877-231-5411.

Do any vehicle repairs qualify for an emissions inspection waiver?

Only the costs of repairs that are related to emissions and which are not under warranty can qualify toward a waiver. Any repairs that are done to correct tampering with equipment do not qualify toward the waiver. If a customer does the repairs, only the cost of the parts used in the repair can qualify for the waiver. You must enter the information about the waiver and the costs into the NYTEST analyzer. You must keep copies of all documents that describe the parts and labor for at least two years.

Can a High-Enhanced Emissions Inspection Station inspect New York State registered vehicles that are registered outside the NYCMA?

New York State registered vehicles that registered outside the NYCMA (Upstate area) are must have the low-enhanced emissions inspection. Only facilities that have inspection stickers for the low-enhanced emissions inspection can conduct this type of inspection.

If a customer requests an inspection, but you do not have stickers for a low-enhanced emissions inspection, advise the customer that an Upstate inspection facility can inspect the vehicle. If the customer requests an inspection at your facility again, advise the customer that you must conduct the high-enhanced emissions inspection, which costs more.  Conduct the inspection and issue a high-enhanced emissions inspection sticker.

You can inspect any vehicle that requires only a safety inspection. For example, you can inspect a vehicle that is exempt from an emissions inspection. Conduct the safety inspection and issue a safety inspection sticker.

If my NYTEST analyzer does not operate correctly, can I continue to conduct emissions inspections?

Do not conduct any high-enhanced emissions inspections if your NYTEST analyzer does not operate correctly.

How do I know if a vehicle must have an original inspection or a reinspection?

What are the fees for a reinspection?

The amount of each fee depends on which items require a reinspection. To determine the correct fee, use the table below or read Section 79.24h of the DMV Regulations.

The NYS Vehicle Inspection Program (NYVIP)

What is the NYS vehicle inspection program (NYVIP)?

The NYVIP is a program that will include a new test of the emission control systems of vehicles that have a model year of 1996 or newer. The NYVIP will help NYS to comply with the Federal Clean Air Act, decrease the emissions from motor vehicles, and reduce air pollution.

The NYVIP uses new equipment at NYS-licensed inspection stations and the on-board diagnostic system (OBDII) of the vehicle to verify that the emissions control systems of the vehicle function correctly. The station uses the new equipment, a modem, and a dedicated telephone line to report the inspection results to the DMV. The inspection station must purchase the NYVIP equipment from SGS TestCom.

What is "OBDII"?

"OBDII" is the acronym that indicates the "on-board diagnostics - version two". The OBDII is a computer system that monitors the correct operation of the engine and the emissions control systems of the vehicle. Vehicles that have a model year of 1996 or newer and that weigh 8,500 lbs. or less have the OBDII. If the OBDII detects a problem that can result in excessive emissions, a malfunction indicator light (MIL) illuminates to inform the driver or automotive technician.

How does the inspector conduct the emissions inspection?

The inspector conducts the safety inspection, the gas cap check and the visual inspection of the emissions control devices, and then the OBDII test, to complete the inspection.

In what circumstances can the NYVIP inspection station issue a 10-day inspection extension to the customer?

The NYVIP inspection station can issue from the NYVIP computer an inspection receipt that includes a 10-day extension of the previous inspection for the vehicle only if:

Will the vehicle pass the inspection if the light bulb in the MIL is removed?

No, the vehicle will fail the inspection. Before the inspector conducts the OBDII test, the inspector must make sure that the MIL operates correctly.

How much additional time is required to conduct the OBDII inspection?

The OBDII inspection will require less than five minutes. The inspector will conduct the safety inspection, the low-enhanced emissions inspection, and then the OBDII inspection to complete the inspection.

Can the station use the NYVIP equipment to diagnose a vehicle for other work at the station?

No. A station can use the NYVIP equipment only for inspections and communications related to inspections. A station cannot install software on the NYVIP computer and cannot use the equipment for work that is not related to inspections.

SGS TestCom will have the option to make available new equipment or software with other functions. The DMV and the Department of Environmental Conservation must approve the new equipment or software. If new equipment or software becomes available and is approved, the DMV will notify the inspection stations.

My station has an OBDII scan tool. Can I use the same scan tool to do the OBDII test?

No. You must conduct the OBDII test with the equipment that you purchase from SGS Testcom. You can use your current OBDII scan tool for other diagnosis and repair work.

How do I use the printer, the barcode scanner, and the modem?

Printer - The station uses the printer to print the receipts, the daily reports, and the other reports related to the emissions inspection. The daily inspection reports from the printer replaces the DMV form VS-1074 previously used to record the inspections. The receipts from the printer replace the rejection notice (VS -1075) previously provided to the motorist.

Barcode scanner - The inspector uses the barcode scanner to enter the information from vehicle registration stickers, inspection stickers and the inspector certification card into the system. The barcode scanner can enter the information more accurately and faster than the inspector can enter the information manually.

Modem - The modem communicates the results of the inspection to the DMV computers. SGS TestCom also uses the modem to send important information about the NYVIP to the inspection stations. For example, if the inspection regulations change, the DMV can provide the information to SGS TestCom, and SGS TestCom can send the text of the change to the NYVIP computer at each station.

Can a NYVIP inspection station in the Upstate Area conduct an emissions inspection on a vehicle that requires the high-enhanced emissions inspection?

Yes, if the vehicle has a model year of 1996 or newer and requires the OBDII inspection. If the vehicle requires a dynamometer test or idle test then they must follow the current process.

Does the DMV require a new type of inspection sticker for the NYVIP?

No.  OBDII tested vehicles will receive a Safety/Emissions Certificate (formerly referred to as the low-enhanced sticker).

Does a certified inspector need a new certification card to conduct the NYVIP inspections?

No. The DMV does not require a new certification card, but an inspector must complete the OBDII training and pass the NYVIP certification test to conduct the NYVIP inspections that include the OBDII emission inspections.

If a vehicle does not pass the NYVIP inspection, can the DMV prevent the renewal of the vehicle registration?

Yes.  The system that prevents a registration renewal for a vehicle that does not pass an emission inspection continues in the NYCMA.  In the Upstate Area, the system to prevent registration renewals takes effect in September 4, 2007. Emissions Inspection Stations for Diesel-powered Vehicles

What diesel-powered vehicles must receive an annual inspection?

All diesel-powered vehicles require an emissions inspection if:

The acronym "DEMA" is printed on the registration documents for these vehicles when the registration is next renewed.

Are any vehicles exempt from this inspection?

The laws require all diesel-powered vehicles described above to receive an emissions inspection. The model year does not exempt a vehicle from the inspection. Read section 79.2 (h) of the inspection regulations to get information about vehicles that are exempt.

Is this inspection required in other areas of NYS? Is this inspection required for vehicles registered in other states?

No, but the NYS Department of Transportation (NYSDOT) or the NYS Police can test any diesel-powered vehicle that has a GVW of more than 8,500 lbs. at any roadside inspection site that is located on any NYS highway. If a vehicle fails the roadside inspection, the inspector can issue a traffic ticket.

Does this program only include large trucks and buses?

No. The program includes all diesel-powered vehicles that have a GVW of more than 8,500 lbs. The program includes some pick-up trucks and some medium-duty trucks.

When does the emissions inspection for a diesel-powered vehicle occur?

The emissions inspection for a diesel-powered vehicle occurs at the time of the annual safety inspection.

Where are the emissions inspections for diesel-powered vehicles conducted?

The inspection is conducted at an official emissions inspection station for diesel-powered vehicles.

An inspection station in the NYCMA is not an official emissions inspection station for diesel-powered vehicles.  Can the station conduct other inspections?

The station can conduct other inspections. The station cannot inspect diesel-powered vehicles.

Is there a different inspection sticker for this program?

Yes. Put the inspection sticker on the windshield.

If the vehicle also requires a heavy vehicle inspection (more than 18,000 lbs. maximum gross weight), do not put the heavy vehicle inspection sticker on the windshield.  Put the heavy vehicle inspection sticker on the front of the vehicle, as near to the front vehicle plate as possible.

If a diesel-powered vehicle passes the safety inspection, but does not pass the emissions inspection, can the inspection station issue a safety inspection sticker?

No. A diesel-powered vehicle that is required to receive a safety inspection must pass both parts of the inspection to receive any sticker.  A waiver of the emissions inspection is available if the cost of repairs exceeds a specific amount.

Can the station use the NYTEST analyzer to record the stickers for the emissions inspections for diesel-powered vehicles? How do I keep the records of the inspections conducted at the station?

No, the station cannot use the NYTEST analyzer to record the stickers for diesel-powered vehicles. Use form VS-1074SD (Record of Inspection) to record the inspection stickers. If a vehicle receives a sticker for a heavy vehicle inspection and an emissions inspections sticker, record both stickers on the same form VS-1074SD. NYTEST stations can continue to use the NYTEST analyzer to record the heavy vehicle inspection stickers for gas-powered vehicles.

How does the inspector conduct the emissions inspection for a diesel-powered vehicle?

The inspector checks the condition of any emissions control devices, and makes sure that the vehicle is at normal operating temperature. The inspector then enters information about the vehicle into the smokemeter used to test the exhaust emissions. The information determines the test standards for that vehicle. The smokemeter measures the exhaust emissions on three snap accelerations, and prints the results. The operator or owner of the vehicle receives a copy of the results. If the vehicle passes the safety inspection and the emissions inspection, the inspector puts the correct sticker or stickers in the correct location on the vehicle. If the vehicle fails any part of the inspection, the operator or owner of the vehicle receives a rejection notice.

A diesel-powered vehicle failed either the safety inspection or the emissions inspection. Is the vehicle required to repeat both inspections again?

A vehicle is required to repeat only the failed part of the inspection if it returns for a reinspection to the same station in 30 days or less. A vehicle that is not reinspected in 30 days or less or goes to a different inspection station must repeat both inspections.

How does an inspection station become an official emissions inspection station for diesel-powered vehicles?

The station must purchase a DMV-approved smokemeter. The cost of the smokemeter is approximately $7,000 to $8,000. A station can conduct an emissions inspection on a diesel-powered vehicle if the station is licensed to conduct a safety inspection for that specific type of vehicle. Do I need to indicate the selling price on form MV-50 if I sell a vehicle wholesale?

No. The selling price is not required on form MV-50 when a vehicle is sold wholesale.

Is a NYS inspection required for a vehicle that is sold to a customer who does not reside in NYS?

No. A NYS inspection is not required for a vehicle registered in another state.

Can I sell a retail vehicle "as is"?

No. Some exceptions allow you to use form MV-907A (Salvage Certificate) to sell a vehicle as "junk".  The DMV cannot issue a title certificate or a registration to a junk vehicle or a salvage vehicle that is rebuilt unless the vehicle passes a salvage vehicle examination.  If a title certificate is issued it will receive a brand that displays "REBUILT SALVAGE:NY".

Must I provide a warranty on a vehicle that has at least 110,000 miles and which was sold to a retail customer for $1,295?

These terms refer to the warranties described by the Office of the Attorney General in the Lemon Law. The Vehicle and Traffic Law requires a dealer to complete the Used Vehicle Certification on form MV-50.  The law applies to all vehicles sold at any selling price and which display any odometer reading. The vehicle must be acceptable for use on the road at the time of sale.

I cannot get the title certificate for a vehicle I sold.  The temporary registration I issued to the customer expires soon. Can I issue another temporary registration?

No. According to the DMV Commissioner's Regulations, you cannot sell a vehicle if you do not have proof of ownership. You cannot issue an additional temporary registration under any circumstances.

Where can I get a surety bond?

Contact a surety insurance company. Make sure that the business name and mailing address on the bond exactly match the business name and mailing address on your DMV facility license. Make sure that you write your Facility Number on the bond.

What is the amount of the bond that a dealer is required to have?

A dealer who is licensed as a used vehicle dealer and who sold 200 or fewer vehicles during the previous calendar year must have a bond in the amount of $10,000.

A dealer who is licensed as a used vehicle dealer and who sold more than 200 vehicles in the previous calendar year must have a bond in the amount of $25,000.

A dealer who is licensed as a new vehicle dealer or as a qualified dealer must have a bond in the amount of $50,000.
